Biggin Hill Airport v Bromley LBC, 22 November, 2000 (High Court).
The High Court has considered the application of the Human Rights Act 1998 to the user clause of a lease granted before the Act came into force. The lease of the airport was granted in 1994 by the local authority. After the Human Rights Act came into force a group of local residents objected to a proposed expansion of the airport. The court held the the Act could not make unlawful a contract which had been entered into before the Act came into force.
