In Athis v Blue Coat School the EAT held that a tribunal, in dismissing a sex discrimination claim brought by an employee who had not been granted a pay rise while on maternity leave, had failed to take account of the fact that she had not been made aware of a notice displayed in the school staff room outlining her right to make representations to the Head about the pay review.
