In Williams v The University of Nottingham, the EAT upheld a tribunal's decision that it did not have jurisdiction to hear claims of unfair dismissal and disability discrimination brought by a senior lecturer employed by Nottingham University to work in Malaysia.
The EAT held that the question addressed by section 68(2A)(b) of the Disability Discrimination Act 1995 (whether work was done "for the purposes of the employer's business carried on at its establishment in Great Britian") was the same as the question posed by the House of Lords in Lawson v Serco in the context of an unfair dismissal claim (namely, whether work was done "for the purposes of a business carried on in Great Britain").
