An update on the publication of ICSID decisions and awards.
The International Centre for the Settlement of Investment Disputes (ICSID) Secretariat has announced a new initiative in which it intends to make more ICSID jurisprudence publicly available. At present, ICSID publishes its decisions and awards (with the consent of the parties) on the ICSID website or in the ICSID Review - Foreign Investment Law Journal. With this new initiative, ICSID aims to provide access to as much ICSID case law as possible, including procedural and substantive rulings. To achieve this, the Secretariat plans to contact parties to concluded cases in order to seek their authorisation to publish decisions, orders and awards that have not yet been made publicly available. Where parties consent to publication, the case law will be published on ICSID's website. If parties view some of the information contained in the decision or award as confidential, the Secretariat will seek their consent to publish the rulings with appropriate excerpts or a general description of the relevant information.
