PLC Arbitration has published an Article, The challenges of arbitrating in Africa, authored by John Miles, Chairman of Africa Legal Network, and Kamal Shah (Partner) and Leonie Parkin (Associate) of Stephenson Harwood.
The article covers the following key challenges of arbitrating in Africa:
  • The lack of institutions and appointing authorities.
  • The lack of arbitrators.
  • The lack of expertise.
  • The local courts and politics (including recent case studies).
  • The local law.
The article also explains that, despite these challenges, there will be an inevitable rise in disputes with an international dimension. This will compel general counsel and legal officers of corporations in Africa to pay more attention to arbitration as a method of resolving disputes between domestic and foreign investors.
