Plan Language, Waiver of 2009 Required Minimum Distributions | Practical Law

A Standard Clause for a plan document of an employee pension benefit plan under the Employee Retirement Income Security Act of 1974 (ERISA) providing for a waiver of 2009 required minimum distributions (RMDs) described in Internal Revenue Code (Code) Section 401(a)(9) under the Worker, Retiree, and Employer Recovery Act of 2008 (WRERA). Under WRERA, no RMDs were required to be paid for the 2009 plan year. Plans should have been amended by the last day of the 2011 plan year to reflect the treatment of 2009 RMDs.
