This Law Firm Publication by Ogletree, Deakins, Nash, Smoak & Stewart, P.C. discusses Millman v. Polymer Packing, Inc., in which the New Jersey Supreme Court held that an employer does not have an affirmative duty to inquire about the source of a confidential customer list that a new hire brings with him. The court found that the employer in Millman had no reason to think that the list was anything other than the employee's personal list of customers.
