Local authorities may only charge disbursement costs of providing CON 29R information under EIR (First-tier Tribunal (Information Rights)) | Practical Law

On 22 March 2013, the First-tier Tribunal (Information Rights) clarified that local authorities may not charge for providing the environmental information used to complete a CON 29R form if the information is inspected onsite; and they may only charge for disbursements, not staff time, under the Environmental Information Regulations 2004 (SI 2004/3391). The tribunal also considered the leading case on the issue, Kirklees Council v Information Commissioner and Pali Ltd [2011] UKUT 104 (AAC).
