This Law Firm Publication by Jackson Lewis LLP discusses Delaware's recently enacted Gender Identity Nondiscrimination Act, which prohibits gender identity discrimination in the workplace, public accommodations, housing and public works contracting. The law, which is effective immediately, defines gender identity as gender-related identity, appearance, expression or behavior, regardless of a person's assigned sex at birth. The law does not require medical proof of any physical changes and places the burden on the employer to accommodate transgender requests for transition based on the transgender employee's consistent presentation of gender identity.
