The First-tier Tribunal (Information Rights) has ruled that the disclosure under the Freedom of Information Act 2000 of the existence of a complaint of professional misconduct against an individual where there was no finding of wrongdoing was not always unfair and therefore a breach of the data protection principles. (Foster v Information Commissioner, Case EA/2013/0176, 13 January 2014.)
