Jackson Lewis: Philadelphia Employers Must Accommodate Pregnant Workers | Practical Law

This Law Firm Publication by Jackson Lewis P.C. discusses a new Philadelphia ordinance requiring employers, upon request, to reasonably accommodate an employee's needs related to pregnancy, childbirth or a related medical condition, unless doing so will cause an undue hardship. Employers may raise as an affirmative defense that the person aggrieved could not, with reasonable accommodations, satisfy the “requisites of the job,” a term left undefined. The ordinance also states that it should not be construed to affect any other law relating to sex or pregnancy discrimination. Philadelphia joins other jurisdictions that have enacted similar laws including Maryland, New Jersey and New York City.
