This note explains what an application for relief from sanctions is and when parties may need to make one. It sets out the requirements under CPR 3.9 and the approach the court will follow when deciding whether to grant relief. It explains the three stage test introduced in Denton v White and other appeals [2014] EWCA Civ 906 and how this is applied.
