The US Patent and Trademark Office (USPTO) has announced the creation of a webpage dedicated to third-party preissuance submissions under 35 U.S.C. § 122(e).
The USPTO has released a webpage devoted to third-party preissue submissions under 35 U.S.C. § 122(e). The webpage, which is a spin off of the Leahy-Smith America Invents Act (AIA) micro-site, hosts information specifically related to preissuance submissions including filing tips, frequently asked questions and statistics.
The preissuance submission provision of the AIA became effective on September 16, 2012 (35 U.S.C. § 122(e)). This provision provides a mechanism for third parties to submit patents, published patent applications or other printed publications of potential relevance to the examination of a patent application with a concise description of the asserted relevance of each submitted document.
