This Law Firm Publication by Jackson Lewis P.C. discusses the recent decision in Olson v. Push, Inc. in which the Minnesota federal district court held that the Minnesota Drug and Alcohol Testing in the Workplace Act (DATWA) does not apply to employees or applicants who work or are applying to work outside Minnesota. Although this is a district court case and therefore non-precedential, it will likely be of interest to employers facing lawsuits under DATWA as there is little existing guidance in this area.
