In Salford Estates (No.2) Ltd v Altomart Ltd [2014] EWCA 1575 Civ, the Court of Appeal considered whether the mandatory stay imposed by section 9 of the Arbitration Act 1996 applies to a winding up petition presented on the grounds of the company being unable to pay its debts.
