Jackson Lewis: New York City Limits Employers' Use of Credit Information of Applicants, Employees | Practical Law

This Law Firm Publication by Jackson Lewis P.C. addresses New York City's newly-enacted "Stop Credit Discrimination in Employment Act" amending the New York City Human Rights Law to prohibit employers from discriminating against employees or applicants based on their consumer credit histories, including information the employee or applicant provides pertaining to his/her creditworthiness and credit payment history. The new law also prohibits employers from requesting or using the consumer credit histories of employees or applicants for employment purposes, subject to several limited exceptions, including for certain public safety-related positions and positions requiring security clearance. The new law takes effect on September 3, 2015.
