This Legal Update reports on select federal administrative agency developments which occurred through August 2015, and which are not covered in our full-length Legal Updates, such as information about agency posters, notices and agreements with agencies of states and sovereign nations.
Department of Homeland Security (DHS)
- On August 25, 2015, the DHS announced in a Notice in the Federal Register that the Secretary of Homeland Security is extending the designation of Haiti for Temporary Protected Status for 18 months, from January 23, 2016 through July 22, 2017 (Extension of the Designation of Haiti for Temporary Protected Status, 80 FR 51582-01).
- On August 25, 2015, the DHS and ICE announced in a Notice in the Federal Register that it will extend the effective date (until July 22, 2017) of its earlier notice suspending certain requirements for F-1 nonimmigrant students whose country of citizenship is Haiti and who are experiencing severe economic hardship as a direct result of the January 12, 2010 earthquake in Haiti (Extension of Employment Authorization for Haitian F-1 Nonimmigrant Students Experiencing Severe Economic Hardship as a Direct Result of the January 12, 2010 Earthquake in Haiti, 80 FR 51579-02).
US Citizenship and Immigration Services (USCIS)
- On August 31, 2015, USCIS announced that it has simplified the process for paying the USCIS Immigrant Fee online in the electronic immigration system. The revised process reduces the amount of information required from individuals immigrating to the US as lawful permanent residents and now allows anyone to pay the fee for the immigrant.
- On August 24, 2015, USCIS announced that it will discontinue its legacy e-Filing system to maintain data security standards and focus resources on its replacement Electronic Immigration System.
DOL
Office of Federal Contract Compliance Programs (OFCCP)
- On August 3, 2015, the OFCCP released its employment discrimination complaint form in five new languages (Spanish, Chinese (Cantonese or Mandarin), Korean, Vietnamese and French). The forms are available on OFCCP's website.
- The OFCCP has released a new voluntary educational poster. The new poster, which employers, including government contractors, need not post, has been provided by OFCCP to increase public awareness of the OFCCP's role.
Wage and Hour Division (WHD)
- On August 6, 2015, the WHD announced that it had signed a three-year Memorandum of Understanding with the Idaho DOL to prevent the misclassification of employees as independent contractors or other non-employees.
Department of State (DOS)
- On August 25, 2015, the DOS published a Final Rule in the Federal Register that adopted as final an interim final rule published in the Federal Register on August 28, 2014. Specifically, the rule implemented changes to the Schedule of Fees for Consular Service.
