In Tomasova (Judgment) French Text [2016] EUECJ C-168/15, the Court of Justice of the European Union (CJEU) considered the circumstances in which a member state would incur liability as a result of a national court decision granting enforcement of an arbitral award that gave effect to a term of a consumer contract which was unfair within the meaning of Directive 93/13/EEC on Unfair Terms in Consumer Contracts.
