This Practice note identifies when the court is entitled to exercise its supportive powers in respect of witness evidence to be used in arbitration proceedings. Although the arbitral tribunal will make most of the necessary procedural decisions and directions on witness evidence, there are situations where court support may be needed. The note offers guidance on when and how to apply to the English court.
