In Patrick Carden v Pickerings Europe Limited the EAT considered the application of paragraph 6 of Schedule 1 to the DDA regarding continuing measures. The EAT remitted the case to the original employment tribunal to decide if pins and plates inserted in a claimant's ankle amounted to continuing measures.
