The ECJ in Vergani v Agenzia delle Entrate, Ufficio di Arona held that the Equal Treatment Directive (76/207/EEC) precludes a provision in Italian law which reduces the amount of tax due on redundancy payments made to men over the age of 55, but to women over the age of 50.
