An update on the High Court decision in Department for Business Enterprise & Regulatory Reform v Dermod O'Brien and another, 10 February 2009, in which the court allowed an appeal against disclosure under the Freedom of Information Act 2000 on the basis of the exemption contained in section 42 of the Act.
