Covered Military Member

Under the regulations implementing the Family and Medical Leave Act (FMLA) in effect before March 8, 2013, an employee's family member who is on active duty or a call to active duty status and who is that employee's:
  • Spouse.
  • Parent.
  • Son or daughter of any age, who may be related to the employee:
    • biologically;
    • through adoption;
    • through foster care;
    • as a stepchild;
    • as a legal ward; or
    • by the employee's standing in loco parentis.
The FMLA's implementing regulations that became effective March 8, 2013 no longer use the defined term "covered military member" and instead refer to a military member who is on covered active duty, is on call to covered active duty status, or has been notified of an impending call or order to covered active duty status.
