Linked Plan

A nonqualified deferred compensation plan under which the amount deferred or timing of payment is affected by either:
  • The provisions of a qualified plan.
  • Another nonqualified deferred compensation plan.
For example, linked plans include supplemental plans that provide executives with retirement benefits that exceed those that they are eligible to receive under their employer's qualified plan because of limits imposed by the Internal Revenue Code (IRC).
Linked plans are subject to Section 409A of the IRC. If a linked plan violates Section 409A, there are special rules governing linked plan corrections.
