On 3 November 2010, the Supreme Court handed down its judgment in Dallah Real Estate and Tourism Holding Co v The Ministry of Religious Affairs, Government of Pakistan [2010] UKSC 46. Their Lordships upheld the High Court and Court of Appeal's refusal to enforce an ICC award made against the government of Pakistan by a tribunal sitting in France. Enforcement was refused on the ground that the government of Pakistan had not consented to the jurisdiction of the ICC tribunal as a matter of French law.
