The IBA Guidelines for Drafting International Arbitration Clauses are now available online. The guidelines inform drafters of the choices available and the pitfalls to avoid when drafting international arbitration clauses. (Free access.)
The International Bar Association's (IBA) new IBA Guidelines for Drafting International Arbitration Clauses, which were developed by a task force appointed by the IBA Arbitration Committee, were approved in October 2010 by the IBA Council at the IBA Annual Conference in Vancouver. This followed a public consultation earlier in 2010 (see Legal update, IBA latest developments).
The guidelines aim to assist arbitration specialists, in-house counsel and business lawyers by providing a succinct and accessible approach to drafting international arbitration clauses. The guidelines cover both basic and more complex drafting issues and are divided into five sections:
  • Basic drafting guidelines.
  • Optional elements.
  • Multi-tier dispute resolution clauses.
  • Multi-party arbitration clauses.
  • Multi-contract arbitration clauses.
These sections provide numerous guidelines and are supplemented with explanatory comments that include specific recommended clauses.
