A Practice Note providing an overview of compensable working time issues under the Fair Labor Standards Act (FLSA), including the Portal-to-Portal Act, the integral and indispensable test for compensability of preliminary and postliminary activities, timekeeping and recordkeeping requirements, the de minimis doctrine, donning and doffing, meal periods and rest breaks, travel, training, and off-the-clock work. This Note is based on federal law. State and local wage and hour law may impose different or additional requirements on the compensability of certain activities.
