This Ford & Harrison LLP memorandum discusses the New Jersey Department of Labor's (NJDOL) recent amendments to New Jersey's wage and hour regulations. The amended regulations incorporate the federal Fair Labor Standards Act's (FLSA) white collar exemptions, including the administrative, executive, professional and outside sales exemptions. However, in making the change, the NJDOL apparently inadvertently eliminated the commissioned sales exemption previously recognized under state law.
