In MGN Ltd v United Kingdom [2011] ECHR 66, the European Court of Human Rights upheld MGN's claim that the requirement that MGN pay the claimant's success fees in Campbell v MGN Ltd [2004] UKHL 22 was a violation of its right of freedom of expression. This article considers the implications of that decision.
