In R (Khadri) v Birmingham City Council and another [2012] EWCA Civ 1432, the Court of Appeal refused the appellant permission to appeal the local authority's assessment of his age on the basis that the local authority should have reconciled its assessment of his age with that reached by the Secretary of State for the Home Department.
