The US Copyright Office announced it would host a public hearing to discuss issues relating to the consideration of a federal resale royalty right.
On March 28, 2013, the US Copyright Office issued a Notice of Public Hearing, which will take place on April 23, 2013. At the request of Congress, the hearing will discuss issues relating to the consideration of a federal resale royalty right in the US, including the following topics:
  • The changing legal landscape.
  • Portability of the secondary art market.
  • The effect on the primary art market and the incentive to create new works.
  • First sale and the free alienability of property.
  • Visual artists and sales of works.
  • The Equity for Visual Artists Act.
  • The effect on museums.
  • Constitutional concerns.
Parties interested in attending the hearing should submit a participation request form which can be found on the Copyright Office's website.
