Foley Hoag: Out-of-state Workers May Sue under Massachusetts Wage Act | Practical Law

This Law Firm Publication by Foley Hoag LLP discusses the Massachusetts Supreme Judicial Court's recent decision in Dow v. Casale, holding an employee who lives and works outside of Massachusetts can sue for unpaid wages under the Massachusetts Wage Act if his employment is sufficiently connected to the Commonwealth. The plaintiff in Dow was a Florida resident who worked mainly out of his Florida home except for up to 12 business trips per year to Massachusetts. The court held the plaintiff could bring a claim under the Act in part because the plaintiff's employer was headquartered in Massachusetts, the employer's physical facilities and customers were in Massachusetts, and the plaintiff was paid out of Massachusetts.
