This Legal Update reports on significant changes to the local rules and procedures for all US federal district and appellate courts between August 14 and 20, 2013. It also reports on changes to the individual practice rules for judges in select district courts during this time period.
Federal Rules of Civil Procedure
On August 15, 2013, the public comment period opened for proposed amendments to the following Federal Rules:
- Bankruptcy Rules 2002, 3002, 3007, 3012, 3015, 4003, 5005, 5009, 7001, 9006, and 9009, and Official Forms 17A, 17B, 17C, 22A-1, 22A-1Supp, 22A-2, 22B, 22C-1, 22C-2, 101, 101A, 101B, 104, 105, 106Sum, 106A/B, 106C, 106D, 106E/F, 106G, 106H, 106Dec, 107, 112, 113, 119, 121, 318, 423 and 427.
- Civil Rules 1, 4, 6, 16, 26, 30, 31, 33, 34, 36, 37, 55, 84 and Appendix of Forms.
The public comment period closes on February 15, 2014.
Third Circuit
Eastern District of Pennsylvania
Judge John R. Padova updated his Scheduling Information Report and his Rule 16 Scheduling Order.
Middle District of Pennsylvania
The US District Court for the Middle District of Pennsylvania updated its ECF registration form.
Sixth Circuit
Northern District of Ohio
The US District Court for the Northern District of Ohio updated its fee schedule. The fee to obtain a power of attorney increased from $39 to $46.
Seventh Circuit
Northern District of Illinois
Magistrate Judge Donald G. Wilkerson updated his Case Management Procedures.
Eighth Circuit
Western District of Arkansas
The US District Court for the Western District of Arkansas posted a new General Order suspending the $10.00 Biennial Assessment of Library Fund fees for attorneys admitted to practice in the Western and Eastern Districts of Arkansas, effective September 1, 2013.
Ninth Circuit
Central District of California
Judge Jesus G. Bernal posted a new Civil Trial Scheduling Order and a new Order Setting Scheduling Conference.
Judge Virginia A. Phillips posted an Order Setting Scheduling Conference.
Northern District of California
Judge Yvonne Gonzalez Rogers posted a new Standing Order in Civil Cases. A copy of the previous version is available here.
District of Idaho
The US District Court for the District of Idaho amended its local rules, including Civil Rules 3.1, 67.2, 72.1, 77.1, 83.6 and Criminal Rule 83.6, effective August 15, 2013. A redline detailing the changes is available here.
