Briefadavit

A colloquial term for an affidavit or affirmation that includes legal citations and arguments. Under the rules governing many New York courts an affidavit or affirmation should include only facts. Legal citations and arguments should be set out in a memorandum of law, or brief. Although using briefadavits is risky because courts need not consider them, they are commonly used by New York state practitioners.
