This Law Firm Publication by Jackson Lewis P.C. discusses a new law in Hawaii amending Hawaii's existing medical marijuana law to create a system for delivering medical marijuana while continuing to recognize employers' right to maintain a "zero tolerance" policy on use of medical marijuana in the workplace. The new law recently signed by Governor David Ige expressly states that permitted medical marijuana use does not apply to the workplace. Even with the passage of this new law, marijuana remains a Schedule I drug under Hawaii law, leaving unresolved issues of whether a positive marijuana drug test constitutes workplace use and whether employers must allow the use of marijuana as part of a reasonable accommodation of an underlying medical condition.
