This note considers when promotional expenses, such as corporate hospitality or the giving of customary gifts such as mooncakes, may constitute offences under the Chinese and foreign bribery and corruption regimes that apply to companies operating in China. It also addresses the compliance measures companies should implement to minimise the risk that employees will commit a violation.
