3	Ninth Circuit rules that DOJ can subpoena non-privileged ... On 7 December 2010, in In re Grand Jury Subpoenas, the Ninth Circuit ruled that the US Department of Justice (DOJ) can subpoena non-privileged documents that originated outside of the country, but were sent to law firms within the United States because of civil discovery. In connection with the civil litigation, the defendants produced documents that originated outside of the United States to the law firms representing them, whereby the documents came to be located within the United States and, according to the Ninth Circuit, within the jurisdiction of the DOJ. 4	US court applies federal law enforcement privilege to ... The DC District Court has applied the federal law enforcement privilege to deny access to investigative memoranda obtained through a leniency programme by the Department of Justice (DOJ) Antitrust Division. 5	FTC implements rule changes for adjudicative proceedings On 27 April 2009, the US Federal Trade Commission (FTC) adopted as final the interim amendments to the FTC's Rules of Practice for adjudicative proceedings that it announced in December 2008. In addition to implementing the interim rule revisions, the FTC amended several rules and eliminated one rule.
