A Practice Note addressing settlement issues that arise during mediation in a civil suit pending in the Superior Court of New Jersey or a New Jersey Municipal Court under the Complementary Dispute Resolution Programs (CDR). This Note identifies methods for breaking deadlocks in mediation and provides guidance on how to formalize a settlement agreement the parties negotiate as a result of mediation. This Note also describes the contents of a settlement agreement, explains how to dismiss pending legal proceedings after settlement, and identifies the parties' options if they do not reach a settlement during mediation.
