A Checklist of issues that plaintiff's counsel should consider before commencing an action in the New Jersey Superior Court, Law Division, Civil Part or a non-foreclosure action in the Chancery Division, General Equity Part. This Checklist addresses taking the representation, assessing the plaintiff's potential claims, formulating the legal theories, evaluating the available relief, determining if a jury trial is available, analyzing potential counterclaims and cross-claims, naming the proper parties, and selecting the forum and venue for the action.
