A sample joint defense and confidentiality agreement (JDA) that allows parties with common legal interests related to anticipated or pending civil litigation in a Massachusetts state court to share information without waiving the attorney-client privilege and help to preserve work product protection and other applicable privileges and protections. This agreement may also help protect against the disqualification of one party's counsel resulting from having received other parties' privileged or protected information under this agreement.
