This Practice Note provides an overview of the traditional provisions for small business debtors in the Bankruptcy Code if a small debtor elects to be a small business case, as opposed to the subchapter V provisions in Chapter 11 enacted under the Small Business Reorganization Act. This note addresses the qualifications for being a small business case, the mandatory reporting requirements and plan deadlines, and the practical considerations for filing a small business case as defined in the Bankruptcy Code.
