Flowcharts to aid counsel in determining whether a publication qualifies as prior art to a claimed invention under the current Leahy-Smith America Invents Act (AIA) or pre-AIA patent law. They address published documents, including US and foreign patents and published patent applications, Patent Cooperation Treaty (PCT) publications, and non-patent publications. They do not address other types of prior art.
