The US Department of Labor (DOL) announced a July 2016 timetable for issuing a Final Rule updating the regulations governing the white collar exemptions from the minimum wage and overtime pay protections of the Fair Labor Standards Act (FLSA). The proposed regulations would extend minimum wage and overtime protections to nearly 5 million workers within the first year of its implementation by increasing the minimum compensation and salary levels required for exemption.

The US Department of Labor (DOL) announced a July 2016 timetable for issuing a Final Rule updating the regulations governing the white collar exemptions from the minimum wage and overtime pay protections of the Fair Labor Standards Act (FLSA). The proposed regulations would extend minimum wage and overtime protections to nearly 5 million workers within the first year of its implementation by increasing the minimum compensation and salary levels required for exemption.
On November 19, 2015, the Office of Management and Budget's (OMB) Office of Information and Regulatory Affairs published its Fall 2015 Regulatory Agenda, identifying a July 2016 timetable for publication of the Final Rule concerning the DOL's revised regulations governing the FLSA's Section 13(a)(1) exemptions. The proposed regulations provide for:
  • An increase of:
    • the minimum salary level required for executive, administrative, and professional (white collar) exemptions; and
    • the minimum annual compensation required to qualify for the highly compensated employee exemption.
  • A method for updating those salary and compensation levels going forward.
The DOL last updated these regulations in 2004.
