This Practice Note analyzes, and suggests ways to maximize, the various privileges and protections that may shield mediation communications from disclosure to third parties who are not involved in the mediation. In particular, this Note addresses the mediation privilege, attorney-client privilege, work product doctrine, and Ohio Rule of Evidence 408.
