This Legal Update reports on significant changes to the local civil and criminal rules and procedures for all US federal district courts and appellate courts between December 2 and 8, 2015. It also reports on changes to the individual civil and criminal practice rules for the judges in select district courts during this period.

Amended FRCP 4(m)

Effective December 1, 2015, amended FRCP 4(m) reduces the time for service to be effected from 120 days to 90 days after the complaint is filed. Several US federal district courts have ordered that amended FRCP 4(m) does not apply to cases pending as of December 1, 2015. A sample of this order can be accessed here.

Federal Circuit Court of Appeals

The US Court of Appeals for the Federal Circuit posted a notice that it amended Federal Circuit Rules of Practice 28(a)(11) and 28(f), and added Rule 30(b)(4)(E), effective January 4, 2016.

Southern District of New York
