A Practice Note describing the considerations and options available to parties who wish to include in their arbitration agreement a provision limiting disclosure and the exchange of information in a future US arbitration. This Note discusses the factors that parties may consider when deciding whether to agree to limit document requests, depositions, requests for electronically stored information (ESI), interrogatories, and requests to admit in a future dispute.
