At the end of 2015, South Africa enacted the Protection of Investment Act, 2015. This new legislation provides protections for foreign investors in South Africa's national courts, but these protections are less robust than those contained in most bilateral investment treaties (BITs). The Act also does not provide for investor-state arbitration.
