Court and Judge Rules Update: April 27 – May 3, 2016

This Legal Update reports on significant changes to the local civil and criminal rules and procedures for all US federal district courts and appellate courts between April 27 and May 3, 2016. It also reports on changes to the individual civil and criminal practice rules for the judges in select district courts during this period.
US Supreme Court
The Supreme Court adopted the following rule amendments and transmitted them to Congress on April 28, 2016:
- Appellate Rules 4, 5, 21, 25, 26, 27, 28, 28.1, 29, 32, 35, and 40, and Forms 1, 5, 6, new Form 7, and new Appendix.
- Bankruptcy Rules 1010, 1011, 2002, 3002.1, 7008, 7012, 7016, 9006, 9027, 9033, and new Rule 1012.
- Civil Rules 4, 6, and 82.
- Criminal Rules 4, 41, and 45.
These rule amendments go into effect on December 1, 2016.
Second Circuit
Southern District of New York
The US District Court for the Southern District of New York posted standing order No. 16-Misc-168, regarding local criminal rule 58.1.
Judge Analisa Torres updated her individual practices in civil cases. A copy of the previous version is available here.
Judge Gregory H. Woods updated his individual rules of practice in civil pro se cases A copy of the previous version is available here.
Magistrate Judge Kevin N. Fox updated his:

Third Circuit
Eastern District of Pennsylvania
Judge Gene E.K. Pratter updated her general pretrial and trial procedures. A copy of the previous version is available here.
Fifth Circuit
Fifth Circuit Court of Appeals
The US Court of Appeals for the Fifth Circuit updated its ECF filing standards. A copy of the previous version is available here.
Western District of Texas
The US District Court for the Western District of Texas posted a new standing order regarding sealing of warrants.
Sixth Circuit
Eastern District of Michigan
The US District Court for the Eastern District of Michigan has updated its local rules and electronic filing policies and procedures, effective May 1, 2016. The court posted a notice and redline of the changes to both the local rules and the electronic filing policies and procedures.
Seventh Circuit
Northern District of Illinois
Judge Jorge L. Alonso updated his case procedures for protective orders, revising requirements on the subject line for emailed requests of proposed orders.
Judge Thomas M. Durkin posted a notice regarding extensions of procedural deadlines.
Ninth Circuit
Ninth Circuit Court of Appeals
The US Court of Appeals for the Ninth Circuit updated its manual of model civil jury instructions. A copy of the previous version is available here.
Central District of California
The US District Court for the Central District of California updated its application for a nonresident attorney to appear in a specific case pro hac vice.
Judge R. Gary Klausner updated his order for court trial. A copy of the previous version is available here.
Judge Beverly Reid O'Connell updated her judges' procedures and schedules, posting a new joint deposition designation submission.
Judge Josephine L. Staton posted an order regarding criminal proceedings.
Northern District of California
The US District Court for the Northern District of California updated its instructions for completing ADR forms for selection of an ADR process.
Judge Jeffrey S. White updated his standing order on recusal. A copy of the previous version is available here.
District of Montana
The US District Court for the District of Montana added a new form, regarding pro se requests to file by email per local rule 83.8.
District of Nevada
The US District Court for the District of Nevada updated its local rules, and posted a summary of the amendments.
The court also:
- Added a new form verified petition for permission to practice pro hac vice. A copy of the previous version is available here.
- Added a motion for admission to practice.
- Updated its form for certificate of cash deposit.
- Updated its information and instructions for filing a motion for leave to proceed in forma pauperis.
Eastern District of Washington
The US District Court for the Eastern District of Washington updated its ECF administrative procedures. A copy of the previous version is available here.
Tenth Circuit
Tenth Circuit Court of Appeals
The US Court of Appeals for the Tenth Circuit has approved changes to local rule 34.1(A)(3) regarding when and in what form motions to postpone oral argument must be submitted. The changes take effect May 9, 2016, and will apply to calendars held after that date.
