The Equal Employment Opportunity Commission (EEOC) issued a resource document addressing the rights of employees with disabilities who seek leave under the Americans with Disabilities Act (ADA).
On May 9, 2016, the EEOC issued a new resource document addressing the rights of employees with disabilities who seek leave as a reasonable accommodation under the ADA. The document, titled "Employer-Provided Leave and the Americans with Disabilities Act," comes in the wake of:
  • An increase in disability charges filed with the EEOC, which reached a new high during FY 2015.
  • The EEOC's recognition that many employers named in disability charges had policies restricting employees from taking leave as a reasonable accommodation.
The new resource document:
  • Is intended to:
    • be an educational tool for both employers and employees to explain how to approach leave requests under the ADA; and
    • prevent employers from discriminatorily denying workplace leave to eligible employees.
  • Does not create any new EEOC policy.
  • Provides examples illustrating legal requirements and obligations for employers and employees.
  • Can be accessed on the EEOC's website.
