A Practice Note discussing the transfer of development rights (also known as air rights) under the Zoning Resolution of the City of New York. This Note discusses zoning lot mergers, transfers from landmark buildings, and permitted transfers of development rights within special districts. This Note also discusses practical issues that impact air rights transfers as well as required documents, such as transfer instruments, certifications of parties-in-interest, declarations of zoning lot restriction and zoning lot development agreements.
